Acceptance of Terms

By creating an account or placing an order on freshandfermented.com, you agree to these Terms of Service. If you do not agree, please do not use our website or services.

These terms apply to all purchases of Fresh and Fermented products, whether for pickup or local delivery. We reserve the right to update these terms at any time; continued use of our site after changes constitutes your acceptance of the updated terms.

Orders and Payment

Fresh and Fermented operates on a weekly ordering window. Orders open at the beginning of the week and close before preparation begins — typically midweek. The exact open and close times are displayed on our website and shop page.

Your order is not confirmed until payment is completed. We use Stripe to process all payments securely. We accept major credit and debit cards, Apple Pay, and Google Pay. We do not store your payment information — all payment data is handled directly by Stripe.

Once the order window closes and preparation begins, we cannot add to, modify, or cancel orders. Please review your order carefully before completing checkout.

Products are for personal use only. Resale of Fresh and Fermented products without express written permission is prohibited.

Pickup and Delivery

Pickup: Our primary fulfillment method is customer pickup at our Glen Allen, Virginia location. The exact pickup address and available time window will be included in your order confirmation email. Pickup is available on Fridays.

You are responsible for picking up your order during the designated window. If you are unable to pick up during your selected time, please contact us as early as possible. We will do our best to accommodate you, but we cannot guarantee product availability after the window closes.

Local Delivery: Local delivery is available for orders of $25 or more, within 10 miles of our Glen Allen, VA location. You can select delivery at checkout. Delivery is available on Fridays during a designated window.

We do not ship products by mail. Our batter is a fresh, perishable product and cannot be shipped. All fulfillment is in-person pickup or local delivery only.

Refunds and Cancellations

Because our products are fresh and made to order, our ability to offer refunds is limited. Please review our full Refund Policy for complete details.

In summary: you may cancel your order within 24 hours of placing it and before the preparation cutoff for a full refund. After preparation begins, refunds are not available except in cases of a genuine food safety concern.

Intellectual Property

All content on this website — including text, recipes, photography, branding, and product names — is the property of Fresh and Fermented and is protected by copyright. You may not reproduce, distribute, or use our content for commercial purposes without our written permission.

The Fresh and Fermented name and logo are trademarks of our business. Unauthorized use is prohibited.

Limitation of Liability

Fresh and Fermented is a small family-owned business. To the fullest extent permitted by law, our liability for any claim arising from the purchase or use of our products is limited to the amount you paid for the order in question.

We are not responsible for indirect, incidental, or consequential damages of any kind. Our products are prepared in a home kitchen that may handle common allergens including nuts, dairy, gluten, and sesame. Please contact us if you have severe food allergies before ordering.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Henrico County, Virginia.
